Privacy Policy
This policy outlines my principles regarding the protection of personal information.
This information is collected and disclosed in relation to services and products provided by Centris, Realtor, EGP, Prospect. In all cases, the Agency faithfully protects the privacy of individuals and the integrity of their personal information.
1. Definition
Personal information is any information concerning an individual that can be used to identify them, other than their name, job title, work address and phone number, and email address. Residential address, date of birth, social insurance number, medical and financial information are considered personal information.
2. Responsibility
The Agency is responsible for personal information under its control, including personal information disclosed to third parties for processing and administrative purposes.
For this purpose, the Agency has adopted a privacy policy and policies and practices governing the governance of personal information with the aim of regulating the collection, use, disclosure, storage, and destruction of personal information.
3. Purpose of Collecting Personal Information
The Agency determines the purposes for which it collects personal information before or at the time of collection unless these purposes are self-evident.
4. Consent
The Agency refrains from collecting, using, or disclosing an individual's personal information without their knowledge and consent, except in limited circumstances authorized by law.
5. Limits on Collection of Personal Information
The collection of personal information by the Agency is limited to what is necessary for the purposes it has identified. The Agency always obtains personal information by fair and lawful means.
The Agency may collect and use information from a third party about an individual when authorized by law and with the individual's consent in all other cases.
6. Limits on Use and Disclosure of Personal Information
The Agency does not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required or permitted by law.
The Agency may be required to disclose personal information to third parties, such as suppliers, co-contractors, subcontractors, agents, insurers (such as the Professional Liability Insurance Fund for Real Estate Brokerage in Quebec), professionals, other regulators, or outside Quebec, without the consent of the individual, if such disclosure is necessary for the performance of a mandate or a service or business contract.
7. Retention of Personal Information
The Agency retains personal information for as long as reasonably necessary for the specified purposes or as required by law. When the purposes for which personal information was collected or used have been achieved, the Agency destroys them (through shredding by a professional company), subject to a retention period prescribed by law. In this regard, the Agency's professional obligations require it to keep its records for at least (6) years following their final closure.
8. Accuracy of Personal Information
The Agency makes reasonable efforts to ensure that personal information about individuals is as accurate and complete as required for the purposes for which it is used. A request for correction can only be considered if it is made in writing in accordance with the personal information access request procedure outlined below.
9. Protection of Personal Information
The Agency is committed to taking and implementing security measures to ensure the confidentiality of information.
10. Transparency
The Agency provides individuals with information about its policies and practices for managing personal information. The Agency is transparent about the policy it follows to ensure the protection of personal information.
11. Right of Access, Withdrawal, and Rectification
Subject to applicable laws, upon receipt of a written request from an individual (or their authorized representative), the Agency informs the individual whether it has personal information about them. A person may withdraw their consent to the collection, use, and disclosure of their personal information at any time. This withdrawal is then recorded in writing.
Upon receiving a written request to this effect, the Agency provides a summary of the use that has been or is being made of the information, informs the individual of the identity of third parties to whom it may have disclosed personal information about the individual, and the purposes for which that information is transmitted to the third party. The Agency may refuse a request for access or rectification in cases provided for by law.
